1. Acceptance of Terms

Welcome to CardPriceIQ. By accessing or using the CardPriceIQ website located at www.cardpriceiq.com(the “Site”), including any subdomains, mobile applications, APIs, or related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Services.

CardPriceIQ reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

2. Description of Services

CardPriceIQ provides trading card price tracking, comparison, and market analytics. Our Services aggregate publicly available pricing data from third-party marketplaces including eBay, TCGPlayer, CardMarket, and others to help collectors and investors make informed decisions.

The Services may include, but are not limited to: price guides, market trend analysis, price alerts, portfolio tracking, card search, and editorial content. CardPriceIQ may add, modify, or discontinue any feature at any time.

3. User Accounts

Certain features of the Services may require you to register for an account. You must be at least 18 years of age to create an account. By creating an account, you represent that the information you provide is accurate, current, and complete, and you agree to update such information as necessary to maintain its accuracy.

You are responsible for safeguarding the password associated with your account and for any activities or actions under your account. You agree to notify CardPriceIQ immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
  • Scrape, crawl, or use any automated means to access the Services or extract data without our prior written consent.
  • Interfere with or disrupt the integrity or performance of the Services or third-party data contained therein.
  • Attempt to gain unauthorized access to any portion of the Services, other accounts, or computer systems or networks connected to the Services.
  • Reproduce, distribute, publicly display, or create derivative works of any content from the Services without express permission.
  • Use the Services for commercial purposes, including reselling data, without a separate commercial agreement with CardPriceIQ.

5. Intellectual Property

All content on the Services, including but not limited to text, graphics, logos, icons, images, data compilations, software, and the compilation thereof, is the property of CardPriceIQ or its content suppliers and is protected by United States and international copyright laws.

The CardPriceIQ name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CardPriceIQ. You may not use such marks without our prior written permission.

6. Pricing Data & Disclaimer

CardPriceIQ provides pricing information derived from third-party marketplace data. While we strive for accuracy, all pricing data is provided on an “as is” and “as available” basis. CardPriceIQ does not guarantee the accuracy, completeness, or timeliness of any pricing data.

Pricing data should not be considered as financial advice or as a recommendation to buy, sell, or hold any trading card. You acknowledge that trading card values are inherently volatile and that past performance is not indicative of future results. All investment decisions are made at your own risk.

7. Third-Party Links & Services

The Services may contain links to third-party websites or services, including marketplace listings on eBay, TCGPlayer, and others. CardPriceIQ is not responsible for the content, accuracy, or practices of any third-party website. Some links may be affiliate links, and CardPriceIQ may earn a commission from qualifying purchases.

8. Account Suspension & Termination

CardPriceIQ may suspend or terminate your account and access to the Services at any time, with or without notice, for conduct that CardPriceIQ believes violates these Terms, is harmful to other users of the Services, or is harmful to the business interests of CardPriceIQ or its partners.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Services will immediately cease.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARDPRICEIQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES.

IN NO EVENT SHALL CARDPRICEIQ'S TOTAL LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100.00) OR THE AMOUNT YOU PAID CARDPRICEIQ IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless CardPriceIQ and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, actions, or demands, including without limitation reasonable legal fees, arising out of or related to your use of the Services or your violation of these Terms.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States. Any claim must be filed within twelve (12) months after the cause of action arises, or such claim is permanently barred.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO A JURY TRIAL.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13. Changes to Terms

CardPriceIQ reserves the right to modify these Terms at any time. If we make material changes, we will notify you by updating the “Last Updated” date at the top of this page. Your continued use of the Services after any modifications constitutes acceptance of the updated Terms.
